Tartalmi kivonat: | Apart from that significant modifications were accepted on the field of the civil procedure last year the legislator has changed again the Hungarian Civil Procedure Act in 2009. Thanks to this changing the electronical communication has appaered in the civil procedure law what will be obligatory for some parties after 2010. The study summarizes the new acts's rules. The author deal with the main provisions of the new electronical procedure in general and the 'order to pay' as well. Afterwards she handles the most important regulations of the German's and Austrian's Civil Procedure Act what were compared with the hungarian rules. The author pays attention to the possible dangers of obligatory electronical communication that can derive from especially the lack of the electronical undersign's using. Besides it has further disadvantages too, because its process is very difficult and its establishment also is not so easy because of the lack of the financial background. As a concluison, the author points out the present situation. In her opinion it is not necessary to speed the civil litigation in this way, because the current provisions provide to end the procedures in a reasonable time if the judge and the parties are cooperative. |
