Tartalmi kivonat: | The subject of my publication is the crisis law by purchase contracts in Hungary in the „Horthy- system” (1920-1944). The history of the crisis law is very old, it can be found in the Roman law too. There are some variations of the crisis law, for instance valorisation, effectively clauses, price escalation clauses, blanket-contracts. The judicial practice, which was suspicious with the valorisation, until the 1920’s don’t want to apply the institution, and has established an economic impossibility instead. The economic impossibility was the new appearance of the “clausula rebus sic stantibus”, which was a very important principal in the European private law. In my publication I show the Hungarian history and specifics of the crisis law, then I analyze the dispute between the Hungarian jurists about the economic impossibility. I use Péter Ágoston’s, Béni Grosschmid’s, Károly Szladits’s Bernát Besnyő’s statements and some jurisprudences and cases. The cases concern the purchase and delivery contracts and the option. |
